The website turbochargersplus.com (hereinafter, “Web Site” or “Site”) is owned and operated by Fintel Pty Ltd. (hereinafter “Fintel”). This Site is for your personal, non-commercial use only.
The material contained within the Site is intended for residents of Australia only and shall only be construed and evaluated according to applicable Australian Laws. This material is void outside Australia, and where prohibited by law or regulation.

Products, Content and Specifications

All features, content, specifications, products and prices of products and services described or depicted on this Web Site, are subject to change at any time without notice. Fintel (collectively “we” or “us”), operates and owns this Web Site, and makes all reasonable efforts to accurately display the attributes of products, including the applicable colors; however, the actual color you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors. The inclusion of any products or services on this Web Site at a particular time does not imply or warrant that these products or services will be available at any time. It is your responsibility to ascertain and obey all applicable local, state, federal and international laws (including minimum age requirements) concerning the possession, use and sale of any item purchased from this Web Site. By placing an order, you represent that the products ordered will be used only in a lawful manner and in accordance with our Warranty Conditions and General Terms and Conditions.

Shipping

When an order is placed, it will be shipped to the address designated by the purchaser as long as that shipping address is compliant with the shipping restrictions contained on this Web Site, and within these Terms and Conditions, and is an actual Australian address ONLY. Shipment to Australian addresses takes between 2-4 working days on average. Shipments to WA and NT will add on average an additional 2 working days delivery time.
All purchases from this Web Site and from Fintel by other means, are made pursuant to a shipment contract, and Shipping is provided Free of charge by default (where Express or Additional Shipping has not been paid – see below in BOLD for further details), by a carrier of our choice (generally Australia Post), and as allocated by default under the Free Shipping arrangement.
As a result and for ALL Free Shipping, risk of loss and title for items purchased from this Web Site or from Fintel by any other means, pass to the Buyer upon delivery of the items (taking the items into possession for forwarding) to the carrier.
By opting for the DEFAULT Free Shipping, Fintel assumes that the Buyer has appropriate and alternative Insurance for such items in transit, or has taken the risk upon themselves for such items in transit.
You are responsible for filing any claims with carriers for damaged and/or lost shipments.
EXCEPTION: Where the Buyer has paid Express or Additional Shipment charges (and invoiced as such, as opposed to the Free Shipping provided by default), the seller takes responsibility for (insures) the delivery to the Buyer.

If you live in a location that requires custom duties and/or VAT taxes to be collected you understand that, unless custom duties and/or VAT taxes are collected at the point of sale by Fintel you remain entirely responsible for payment of any/all custom duties and taxes at the time the product is delivered pursuant to your instructions.

If, for any reason, Fintel’s courier or freight account is charged for custom duties and/or VAT taxes, instead of you paying the referenced charges directly, then you hereby authorize Fintel to bill your credit card, account or other for said charges or for the return of goods if they are refused at the point of destination.

You hereby agree that in the event of a breach or threatened breach of the Terms of this Agreement by you, it will not be necessary to prove monetary damages and irreparable harm will be presumed. You further agree to waive any bond requirement, which may be imposed in order for Fintel to obtain any injunction against you.

Trade-Mark Information

Turbochargersplus Australia & Fintel and other names and logos appearing on or in connection with Web Site (the “Marks”) are registered or unregistered trademarks, service marks, trade names and logos owned or licensed by Fintel or their respective owners or licensees. Any use of the Marks, is strictly prohibited. Nothing appearing on the Web Site or elsewhere shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of the Marks.

The Site may provide links to other World Wide Web sites or resources. Fintel has not reviewed these sites and is not responsible for the accuracy, content, privacy policies or availability of information found on sites that link to or from any Fintel Site. Regarding General Returns (non-warranty):
It is at our discretion to grant return, and if return of item is granted / required, you will be notified by reply email.
Note that under circumstances of non-agreement to T&Cs, and where return is granted for other reason outside warranty process, fees may be levied including a restock fee of 40% on returned funds.
Please choose product purchase carefully as:
1) No returns on items for change of mind / incorrect purchase 30 days post purchase date.
2) No returns on sale items for change of mind / incorrect purchase.

Indemnity

You agree to indemnify and hold Fintel, affiliates (and their franchisees and licensees), and subsidiaries, officers, directors, employees, successors and assigns, harmless from any claim, loss or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of our Web Site, your connection to our Web Site, your violation of these Terms and Conditions, or your violation of any rights of another party. This indemnity survives termination of these Terms and Conditions.

Governing Law and Dispute Resolution

You agree that any issue or dispute arising out of or in connection with your use of our Site, intellectual property, the Terms and Conditions, the Privacy Policy, or any matter concerning Fintel shall be governed by the laws of Australia. You agree that any such issue or dispute shall be brought exclusively in the courts located in Australia. If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of our Terms and Conditions remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Web Site or our Terms and Conditions must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Electronic Communications>

The buyer agrees to have invoices sent via email.
The buyer agrees that email communications from Fintel to the Customer constitute an “electronic communication” within the meaning of the Electronic Transactions (Queensland) Act 2001.
The buyer agrees that evidence of the “dispatch” (within the meaning of the Electronic Transactions Act 2001 (QLD)) by Fintel of an email, is also prima facie evidence of the “receipt” of the email by the Buyer within the meaning of the Act.
Unless the contrary is proven the time of receipt will be deemed to be twenty (20) seconds after the time of the “dispatch” of the email.

FORCE MAJEURE

Fintel shall not be liable for any failure or delay in supply or delivery of the Goods where such failure or delay is wholly or partly due to any cause or circumstance whatsoever outside the reasonable control of Fintel including,
but not limited to, war, strikes, lockouts, industrial disputes or unrest, government restrictions or intervention, transport delays, fire, act of God, breakdown of plant, shortage of supplies or labour, storm or tempest, theft, vandalism, civil commotions or accidents of any kind.

Privacy Policy:

Fintel Pty Ltd (owner of this site, marks etc..) has established this Privacy Policy to explain how it protects and manages the personal information that it collects from you (the customer) online.
